Conviction of the Mortgagor and the Mortgagee if the Dispute in the Return of the Mortgage without Mentioning the Loss

: (( )). : :1. .2. . 3. . .This paper, titled ((Explaining the case in which the mortgagor and the mortgagee dispute about the return of the mortgage without mentioning the loss)), is in Al-Hanafi fiqh by Al- Imam Hassan bin Ammar Al-Shranbilali.The idea of this paper is about the case when there will be a dispute between the mortgagor and the mortgagee over the return of the mortgage and which one of them has the right. The paper comprises the following points:1. The cases in which the mortgagor has the right.2. The cases in which the mortgagee has the right.3. Is the mortgage a trust with the mortgagee or a guaranteed loan?I have examined this paper comparing two handwritten copies relying on the books of the school's (Madhhab's) Imams and I have made some conclusions.
